Feinstein's judgment on security issues is extremely suspect, since -- as he points out --- she voted for "Porter Goss, George Tenet, and Michael Hayden, as well as Mike Mukasey, Robert Mueller, and Donald Rumsfeld" without complaint. Looking at that track record, her opinion isn't worth a whole lot. Shut up and get with the program, Diane.

POPSBurris Turned Away From Senate Chamber The problem, of course, is that the Illinois Secretary of State has refused to sign off on Burris's appointment. This actually brings up an interesting question; is it required? Some argue that the signature is just a formality and an "extra-constitutional requirement." On the other hand, constitutionally speaking, the handling of elections is left up to the states. You could argue that this puts Illinois law above the Constitution in this case. But, to grow a third hand, Burris wasn't elected -- does this create a loophole? We live in interesting times.

POPSFranken is the Official Winner -- Unofficially The problem is that, according to Minnesota law, nothing can be certified while legal challenges are still in the works. It's hard to find fault with that -- it seems like a pretty common sense provision to me. But it's frustrating as all hell that the 2008 elections still aren't over. Coleman's suit to bring in some 650 challenged ballots was turned down by the Minnesota Supreme Court, but is almost certain to be appealed to the federal level. So, officially, we can start saying Senator Franken. But we can't say incumbent Senator Franken. Confusing? You bet.

POPSRichardson Withdraws as Commerce Nom This is pretty disappointing news. I thought Richardson was great and I would actually have liked to see him take State, instead of Hillary Clinton. Here's hoping this doesn't pan out as a fullblown scandal or crime. That would be a big surprise -- at least, to me.

"The civilians are not our target. We are looking only after militants. Hamas militants." The only real news here is in the Certificate of Appointment (page 4 of the PDF ), which is signed by Governor Blagojevich, but not by Illinois Secretary of State Jesse White. White has refused to sign off on the appointment, which may give Reid some legal leverage when it comes to rejecting Burris.

The piece goes on: "Anybody who understood this case wouldn’t have voted for Burris," Rob Warden, executive director of the Center on Wrongful Convictions, told ProPublica. Indeed, Burris lost that race, and two other attempts to become governor. Burris’ role in the Cruz case was "indefensible and in defiance of common sense and common decency," Warden said. "There was obvious evidence that was innocent." Putting ambition over justice. I guess we shouldn't be surprised.

The study found that five years after taking a pledge, 82% denied ever pledging. Pledging kids were virtually indistinguishable from non-pledgers in terms of sexual behavior -- including rates of anal and oral sex. The only real difference is that they're less likely to use protection. The next time someone brings up "faith-based solutions," suggest reality-based solutions. This faith-based crap doesn't seem to ever work.

POPSHamas Calls for 'Third Infitada' I hate writing about Israeli/anybody conflicts because it's really hard to get people to realize that the Israeli government as a much a bunch of assholes as whatever bunch of assholes they're fighting with at any given time. Israel's response in this situation is as disproportionate as it always is. There are no good guys in this fight, no one we should really be rooting for. The best we can do is hope that both sides will someday realize that they're going about this all wrong. Israel's system of apartheid guarantees terrorism and terrorism guarantees the continuation of apartheid.

It would be a tremendous injustice if people who were responsible for this monstrous stain on our national record went unpunished. But just this once, we'll give him the benefit of the doubt and just assume he's stupid. His oath of office does not call on him to "to protect and defend against all enemies foreign and domestic." What Dick and George actually swore to do is this: I do solemnly swear (or affirm) that I will faithfully execute the office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States. I think we can all agree that Dick and George have done a really shitty job of that. Maybe they weren't paying attention when they pledged. Dick's practically been daring Obama to prosecute him lately. Here's hoping he does.

"I think that President-elect Obama's going to have to decide whether he wants power without principle or whether he wants to start with a true change, to say that no matter where an investigation will take us, if there are crimes to be found they will be prosecuted." Personally, I vote for the latter. The neocons came up with a lot of creative legal arguments to excuse torture and we ought to make them test those arguments in a criminal court. I think they'd find that their arguments were BS and that they are, quite literally, criminals. I also think that we ought to make it 100% clear that working in the White House isn't a free pass to commit war crimes. We're a nation of laws, not men, and those who break the law should have to answer to the law -- no matter who they are. That's what you call "justice."

I think that in our post-Bush era, Republicans are going to have a little problem -- Americans trust this guy and are more than willing to give him the benefit of the doubt.
